SELLER TERMS

  1. Written information and photos submitted to Zadoon must accurately represent the Equipment being advertised and follow the specification detailed in the Advertise Equipment form.
  2. Before beginning the sales process with a Buyer, Seller must verify ownership of the Equipment and must pass a lien check.
  3. Upon Buyer request, Seller will make Equipment available for a Buyer inspection visit.
  4. Before releasing Buyer information to a Seller to coordinate an on-site inspection visit, the Seller is required to sign an Exclusive Right to Sell pertaining to the particular Buyer party. An Exclusive Right to Sell is not required to begin advertising on Zadoon.
  5. Once funds from the Buyer are deposited for the sale, the Buyer will be provided the location of the equipment and the Seller will have Equipment ready and available for transfer to the Buyer within the agreed-upon time period. If Seller either does not have Equipment in a “ready” condition for transport in the agreed-upon time period, or delays the release of Equipment to the Buyer’s scheduled common carrier or other Buyer conveyance, the Seller will be responsible for full payment of any additional expenses incurred by the Buyer and/or Zadoon due to Seller delay. These expenses may include, but are not limited to, transportation cancellation or re-scheduling fees, transportation delay fees, and hourly or daily average rental cost of equivalent replacement equipment for the buyer, including loading, unloading and transportation costs.
  6. If, for any reason, the Seller fails to release Equipment sold to the Buyer’s scheduled common carrier or other Buyer conveyance, or if the Seller is incapable of releasing the Equipment, the Seller agrees to pay a default penalty equivalent to 25% of the sales price as if the Equipment were sold, as well as any costs incurred by the Buyer and validated by Zadoon.

BUYER TERMS

  1. Buyer agrees to purchase equipment “As-is”. Zadoon is not responsible for the condition of equipment being sold on Zadoon.com. To verify the condition of Equipment, Zadoon can coordinate an inspection by a certified mechanic (additional cost) or a personal on-site inspection visit.
  2. Before releasing Seller information to a Buyer to coordinate an on-site inspection, the Buyer is required to sign a prospective purchase agreement with Zadoon.
  3. Once funds from the Buyer are deposited for the sale, the Buyer will be provided the location of the equipment and the Seller will have Equipment ready and available for transfer to the Buyer within the agreed-upon time period. If Seller either does not have Equipment in a “ready” condition for transport in the agreed-upon time period, or delays the release of Equipment to the Buyer’s scheduled common carrier or other Buyer conveyance, the Seller will be responsible for full payment of any additional expenses incurred by the Buyer and/or Zadoon due to Seller delay. These expenses may include, but are not limited to, transportation cancellation or re-scheduling fees, transportation delay fees, and hourly or daily average rental cost of equivalent replacement equipment for the buyer, including loading, unloading and transportation costs.
  4. Zadoon provides transportation assistance at no additional cost to the Buyer. However, all costs associated with transportation are the responsibility of the Buyer.
